These Terms of Service ("Terms") govern your use of the Heplon website and platform ("Service") operated by Heplon ("we", "us", "our"). By accessing or using our Service, you agree to be bound by these Terms.

1. Use of the service

You may use our Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service in any way that violates applicable laws or regulations.

2. Accounts

When you create an account, you must provide accurate and complete information. You are responsible for safeguarding your account credentials and for all activities that occur under your account.

3. Intellectual property

The Service and its original content, features, and functionality are owned by Heplon and are protected by international copyright, trademark, and other intellectual property laws.

4. User content

You retain ownership of any content you provide through the Service. By using the Service, you grant us a limited license to process your content solely for the purpose of providing and improving the Service. We do not use your content to train AI models.

5. Service availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service is provided on an "as is" and "as available" basis. We may modify, suspend, or discontinue the Service at any time with reasonable notice.

6. Limitation of liability

To the fullest extent permitted by law, Heplon shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.

7. Termination

We may terminate or suspend your access to the Service at any time, with or without cause, with reasonable notice. Upon termination, your right to use the Service ceases immediately. You may request export of your data before termination takes effect.

8. Governing law

These Terms are governed by the laws of the Federal Republic of Germany. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Germany.

9. Changes to these terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the effective date. Continued use of the Service after changes constitutes acceptance of the new Terms.
